Terms of Service & Inspection Disclaimer

1. Nature of Service

My Floor Inspection provides independent, third-party flooring inspection and forensic consulting services. Our inspections are conducted in accordance with applicable industry standards including those established by the National Wood Flooring Association (NWFA), Tile Council of North America (TCNA), ANSI A108 series, and ASTM International testing standards. All inspections are performed by or under the supervision of a certified inspector.

2. Scope and Limitations

Flooring inspections conducted by My Floor Inspection are visual and technical assessments based on conditions present and observable at the time of inspection. The following limitations apply:

  • Inspection findings reflect conditions observable at the time of the site visit. Conditions may change before or after inspection.
  • Concealed conditions (beneath flooring, inside wall cavities, or under furniture not moved by the client) may not be assessed unless specifically contracted.
  • Inspection reports identify conditions consistent with specific failure types but do not constitute a guarantee, warranty, or legal finding.
  • Moisture testing results reflect conditions at the time of testing and may not represent long-term averages or future conditions.
  • My Floor Inspection does not perform remediation, repairs, or any work that may alter the conditions being inspected.

3. Independence and Objectivity

My Floor Inspection operates as an independent third-party inspector. We have no financial interest in the outcome of any inspection, no affiliation with flooring manufacturers, retailers, contractors, or insurance companies, and no obligation to any party other than the client who retained us. Our findings are based solely on the physical evidence observed and applicable industry standards.

4. Expert Witness Disclaimer

When retained for expert witness services, My Floor Inspection provides opinions based on technical findings and applicable industry standards. Expert witness services are provided pursuant to a separate written engagement agreement. Providing expert witness services does not guarantee any particular legal outcome. Our testimony is limited to our area of expertise in flooring inspection and forensic analysis.

5. Payment and Cancellation

Inspection fees are due at the time of booking via our secure Stripe payment portal. The following terms apply:

  • Cancellation 48+ hours before inspection: Full refund.
  • Cancellation 24–48 hours before inspection: 50% refund.
  • Cancellation within 24 hours or no-show: Non-refundable.
  • Rescheduling: Permitted at no charge with 48 hours notice.

6. Report Delivery and Use

Inspection reports are delivered to the retaining client by email within the timeframe specified at booking (typically 2–5 business days following the site visit). Reports are prepared for the exclusive use of the client who retained the inspection. Distribution of reports to third parties (contractors, insurers, opposing counsel) is at the client's discretion. My Floor Inspection takes no responsibility for how third parties interpret or use the report.

7. Limitation of Liability

My Floor Inspection's liability for any claim arising from inspection services is limited to the fee paid for the specific inspection in question. We are not liable for consequential, incidental, or punitive damages arising from the inspection or report. This limitation does not apply to claims of gross negligence or willful misconduct.

8. Governing Law

These terms are governed by the laws of the State of California. Any disputes shall be resolved in Los Angeles County, California.
